You’re not 55 yet, but you fell in love with an independent adult community. The good news? You don’t have to be 55 or older to live in many independent adult communities.

Age restrictions that apply to housing for older Americans is an overlapping tangle of legal regulations and policies. If you’re not yet 55, living with someone who is not yet 55 or seeking a place to live without the boisterous noises of children, finding the correct property type can be difficult.

Retirement Communities

Due to the Housing for Older Persons Act of 1995 (HOPA), traditional retirement homes can restrict residency to those who are 62 or older, and no one may live on the property who’s younger than 62. Once these guidelines are established, age restriction is stringent. The only exceptions are granted to family members who require assistance for a medical condition.

Independent Adult Communities

HOPA gives 55-and-over communities more leeway in their age restrictions. At least 80 percent of all units must have at least one resident that’s age 55 or over, so mixed-aged couples have greater flexibility in finding older-adult housing in independent adult communities. By extension of those restrictions, 20 percent of units can be occupied by residents under the age of 55.

We strive to build a mature community that supports residents who have reached the same life milestones, so 55 Resort Apartments at Water Valley requires that all permanent residents be at least 40 years of age. HOPA requires us to rent at least 80 percent of our units to residents 55 or older. When our resident mix meets regulations, we’re happy to welcome new residents who are between the age of 40 and 55.
